8.1 Definitions Copy

The definitions section defines various terms and points out key words in the policy.

“You and Your” By implication, named insured includes a spouse having the same residence address. The policy defines “you” and “your” as meaning the named insured and a spouse if the spouse lives in the same household. The definitions section does not describe an insured, because that term is given a separate definition under each of the coverages.

These words mean the person named on the declarations and\his or her resident spouse. The 1998 version of the PAP adds, for the first time, a provision eliminating coverage when a spouse moves out of the household. It clearly removes coverage from that person at the earliest of these times:

  • 90 days
  • When the spouse gets another policy in his or her
  • The expiration of the current

Family Member: Family Member means a person related to the named insured by blood, marriage, or adoption, including a ward or foster child, who lives in the same household. A student temporarily away at school is still a family member. In Texas the definition also includes a spouse during a period of separation in contemplation of divorce, even when not a resident of the same household.

Occupying: Occupying means in, upon, getting in, on, out, or off an auto or vehicle.

Trailer: Trailer means a vehicle designed to be pulled by a private passenger auto, pickup, panel truck or van. It also means a farm wagon or farm implement, but only while towed by one of these vehicles.

Your Covered Auto: Your covered auto is defined by the policy as meaning any:

  • The vehicle is shown in the declarations
  • Trailer owned by the named insured
  • Newly acquired additional vehicle on the date the insured becomes the owner (automatic coverage for only 30 days)
  • Newly acquired replacement vehicle on the date the insured becomes the owner (all coverage’s automatic for the remainder of the policy period, except for a 30 day limit on physical damage).
  • Vehicle or trailer used as a temporary substitute for any other covered vehicle which is out of use due to breakdown, repair, servicing, loss or
  • With regard to newly acquired additional vehicles, the 30-day automatic coverage for an additional vehicle will only be as broad as the broadest coverage shown for a vehicle in the declarations. An insured must declare an additional vehicle within 30 days, and any insured who wants broader coverage for a new vehicle will have to declare it immediately.
  • Automatic coverage for a replacement vehicle will be on the same basis as coverage for the vehicle replaced, except that any physical damage coverage will be automatic-only for 30 days. An insured who wants to add physical damage will have to request it immediately, and an insured who wants to continue automatic physical damage coverage for a replacement vehicle must request the coverage within 30 days.
