The following exclusions apply to loss to covered property:
- The insurer does not cover loss to electrical devices or wiring caused by electricity other than lightning.
- The insurer does not cover loss caused by smog or by smoke from industrial or agricultural operations.
Unless specifically insured on the Miscellaneous Property Schedule Endorsement, the insurer does not cover loss caused by a windstorm, hurricane or hail to:- Cloth awnings, greenhouses, and their contents, buildings, or structures located wholly or partially over water and their contents.
- Radio and television towers, outside satellite dishes, masts, and antennas, including lead-in wiring, wind chargers, and windmills.
- The insurer does not cover loss caused by windstorms; hurricane or hail to personal property contained in a building unless the direct force of wind or hail makes an opening in a roof or wall and rain, snow, sand, or dust enters through this opening and causes the damage.
- The insurer does not cover loss by theft of any property:
- Which at the time of loss is not an integral part of any structure covered under Coverage A (Dwelling);
- The insurer does not cover loss to machinery, appliances and mechanical devices caused by mechanical breakdown
The insurer does not cover loss caused by:- Wear and tear, deterioration, or any quality in the property that causes it to damage or destroy itself.
- Rust or rot.
- The dampness of atmosphere, extremes of temperature.
- Contamination.
- Rats, mice, termites, moths, or other insects.
- The insurer does cover ensuing loss caused by the collapse of the building or any part of the building.
- The insurer does not cover loss caused by animals or birds owned or kept by an insured or occupant of the described location.
- The insurer does not cover loss under Coverage A (Dwelling) caused by settling, cracking, bulging, shrinkage or expansion of foundations, walls, floors, ceiling, roof structures, walks, drives, curbs, fences, retaining walls or swimming pools.
- The insurer does not cover loss caused by or resulting from flood, surface water, waves, tidal water or tidal waves, overflow of streams or other bodies of water or spray from any of these whether or not driven by wind.
- The insurer does not cover loss caused by or resulting from freezing while the building is unoccupied unless the insured has used reasonable care to:
- Maintain heat in the building; or
- Shut off the water supply and drain plumbing, heating, and air conditioning systems of water.
- The insurer does not cover loss caused by earthquake, landslide or earth movement
- Governmental Action – The insurer does not cover loss caused by the destruction of property by order of a governmental authority.
- The insurer does cover loss caused by the acts of destruction ordered by governmental authority taken at the time of a fire to prevent its spread if the fire would be covered under the policy.
- The insurer does not cover loss caused by or resulting from mold, fungi, or other microbes.
- Building Laws – The insurer does not cover loss caused by or resulting from the enforcement of any ordinance or law regulating the construction, repair, or demolition of a building or structure.
“Building Laws” exclusion is modified to provide coverage only to the extent described under Perils Insured Against.
Coverage Provided
The insured may use up to $5,000 (at no additional premium) for the increased costs that the insured incurs due to the enforcement of any ordinance or law, which requires or regulates:
- The construction, demolition, or repair of that part of a covered building or other structure damaged by a Peril Insured Against.
- The demolition and reconstruction of the undamaged part of a covered building or other structure, when that building or other structure must be totally demolished because of damage by a Peril Insured Against to another part of that covered building or other structure.
- The remodeling, removal, or replacement of the portion of the undamaged part of a covered building or other structure necessary to complete the remodeling, repair, or replacement of that part of the covered building or other structure damaged by a Peril Insured Against.
- The insured may use all or part of this coverage to pay for the increased costs the insured incurs to remove debris resulting from the construction, repair, or replacement of property as stated under the first bullet above. This is additional insurance and does not reduce Coverage A (Dwelling) the limit of liability.
